These Terms and Conditions apply to you as a client for online ordering (hereinafter referred to as “you” or the“user” or the “client”)

IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS THEN YOU SHOULD NOT ACCESS AND/OR USE THE ONLINE ORDERING (HEREINAFTER NAMED “ONLINE ORDERING APPLICATION”). ACCESS AND/OR USE OF THE ONLINE ORDERING BY YOU SHALL BE DEEMED TO BE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS.
Subject to applicable legal regulations in force, We may, in our discretion, from time to time amend or otherwise modify the Terms and Conditions of Use. We recommend that You carefully read, each time you order online, the Terms and Conditions as they may affect your rights.
These Terms and Conditions describe the general online ordering terms and conditions between Us and You and different rights and obligations of the Parties.
For the sake of clarity, these Terms and Conditions apply (also) in case of online ordering through the application (hereinafter referred to as the “online ordering application” or the “application“; the applications is the online ordering application used by the Client to place its order for different products and/or services (hereinafter referred to as the “products” and/or “services”).
The online ordering application is owned and operated by the licensor of the license agreement regarding the use of the application in order to order online.
Without affecting the generality of the present Terms and Conditions and for the sake of clarity You must also respect the license agreement regarding the use of the application in order to order online.

The Restaurant shall make all the necessary diligences to ensure that the information in relation with the online ordering is accurate and reliable. However, this cannot be infallible and errors may sometimes occur. You should take appropriate steps to verify all information in relation with the online ordering before using it. To the maximum extent permitted according to the applicable law, the Restaurant disclaims any warranty or representation of any kind, whether express or implied, as to any matter whatsoever relating to the online ordering, including without limitation the availability of the online ordering application.
The Restaurant may from time to time revise the information in relation with the online ordering application and/or process and reserves the right to make such changes without any obligation to notify any past, current or prospective clients. In no event shall the Restaurant be liable for any indirect, special, incidental or consequential damages arising out of any use of the information contained herein and/or in relation with the online ordering process.
By ordering online, you acknowledge and agree that the use of the online ordering application and/or processes at your own risk and the maximum extent permitted according to the applicable law, in no circumstances, shall We be liable for any direct, indirect, incidental, special, consequential, or punitive damages, losses, costs or expenses nor for any loss of profit that results from the use of, or inability to use this online ordering and/or any application and/or material on any site linked to this online ordering application (including but not limited to any viruses or any other errors or defects or failures in computer transmissions or network communications) even if We have been advised of the possibility of such damage. In addition, no liability can be accepted by Us in respect of any changes made to the content of the online ordering application and/or process by unauthorized third parties. All express or implied warranties or representations are excluded to the maximum extent permitted according to the applicable law.
The online ordering application and/or process may include content, information or links to third parties or third party sites. The Restaurant is not responsible for the content of any such sites or neither for the content of any third party advertising or sponsorship nor for compliance of such with any regulations. The links may be accessed at the user's own risk and the Restaurant makes no representations or warranties about the content, completeness, or accuracy of these links or the sites hyperlinked to this ordering online application. You agree to hold harmless and relieve the Restaurant from any liability whatsoever arising from your use of information from a third party or your use of any third-party website.
Except otherwise expressly mentioned, all the information in relation with the online ordering application (including without limitation the images, buttons and text) are property and/or available with the permission of the licensor of the license agreement regarding the use of the application in order to order online and holds usage rights over them and, may not be copied, distributed, or reproduced or transmitted in any form or by any mean, electronic, mechanical, photocopying, recording or otherwise, without its prior written permission.
The content referring to specific products (e.g. food items), arrangement and texts layout of the online ordering application and/or process, the trademarks, and any other content, are proprietary and are protected according with the legal regulations in force and cannot be used in any way without the express written permission of the Restaurant.
The Client does not obtain any license or right regarding the information in relation with the online ordering and/or application.
If you decide to order online using the online ordering application, you may be asked to provide full contact details and/or to create an account and you may need to accept cookies. You must keep your data confidential and must not disclose it to anyone. The Restaurant reserves the right to suspend the use of the online ordering application and/or process if you breach the Terms and Conditions.
You acknowledge and agree that all orders are treated as an express intention to purchase the nominated products and/or services for the agreed online prices and We treat this as an binding offer from you to purchase such products and services. Any variations must be in writing, otherwise they will not be binding on either party.
The acceptance of any order for any of the products and/or services shall be at the entire discretion of the Restaurant. Our acceptance of an order may occur when you receive an on-screen message and/or email notification and/or an SMS, confirming your order.
The Restaurant reserves the right to refuse any service, terminate your access to the online ordering application and/or process, remove or edit any content or accept your order/s in its sole discretion and without prior notice to you.
The Restaurant's online ordering application must only be used by persons over the age of eighteen (18) years, or the minimum legal age as permitted by the law or otherwise under the supervision of an adult or guardian.

Any products and/or services provided through the online ordering application are done so on an "as is" and "if available" basis and the Restaurant expressly excludes any warranties, conditions, representations or other terms with respect to the online ordering or the content or products displayed on it, whether express or implied, unless expressly stated to the contrary.
The pictures of the products are for presentation only. The ordered products may have differences (e.g. color, form, etc.) towards the photos existing on the site. The Restaurant is not liable in any way if the description of products is not complete.
Delivery orders are also subject to: i)Your address falling in the defined delivery area of the Restaurant; ii)Availability of the restaurant being online for accepting online orders; iii) Your Order may be subject to a minimum amount per order;
You can pay by any of the methods listed in our checkout screen. Please make sure that if your order is placed using a credit or debit card, the card is valid on the date of your order placement. You may be automatically directed to an online listing referring to Your nearby Restaurant service location. Please note that prices, minimum spend restrictions and maximum cash spend restrictions vary from location to location. In addition, if you order on-line, the price charged may be different to the price for the Products had they been ordered in-store or by telephone.
The online order once placed cannot be modified or cancelled either through the website or offline by calling the restaurant. Anyhow, if you wish to cancel or complain about your order, please call your local restaurant service location, details of which will be included in the confirmatory e-mail sent to you upon placing your order and We can see how we can help you.
We will aim to provide you with your ordered products as close as possible to your requested delivery/collection time but we cannot guarantee the delivery time in all the cases. Delivery time may be affected due to bad weather or traffic conditions. This is to ensure the safety of our riders. Delivery service may be temporarily unavailable in selected areas due to bad weather or unforeseen circumstances.
The Client agrees to accept delivery of the Products at the agreed time and place of delivery. If you have chosen for the Products to be delivered, the Restaurant will deliver the order to the main entrance of the delivery address but any deliveries carried into the delivery address will only be made if the driver and you consent to this. If you are not present to take delivery of the goods at the address given in your order, then We will not refund you the price for your order and will charge you for the full amount of your order.
Risk in the Products shall pass to the Client on delivery. Any software service/software is used and/or downloaded at your own risk. If you are in any doubt as to the suitability of the software service/software to be used and/or downloaded for your computer it is recommended that you obtain specialist advice before using and/or downloading it.
You are responsible for maintaining the confidentiality of your personal details, password and payment details. You agree to accept full responsibility for all your activities in relation with the online ordering (application).
You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions. In case any provision of this agreement is and/or becomes void, illegal, invalid or inapplicable, it shall not affect the validity or the applicability of the other contractual clauses, which shall continue to be in force and to produce legal effects as if the void, illegal, invalid or inapplicable clause was not part of this agreement.
This Terms and Conditions do not affect your statutory rights.
The Restaurant trademarks, as well as the related trademarks of others and related proprietary property are protected from copying and simulation under national and international laws and are not to be reproduced or copied without the express written permission of the Restaurant.
To the fullest extent permitted by law, the Restaurant excludes all liability arising out of its supply of the Products and in particular shall not be responsible for any loss or damage, arising directly or indirectly out of or in connection with delay beyond the estimated delivery or pickup time; any circumstances over which the Restaurant had no control of the consequences and which the Restaurant could not avoid by the exercise of reasonable care, or any indirect or unforeseeable loss suffered or incurred by the Client or others. In any event, the Restaurant's liability to the Client shall not exceed the total price charged for the relevant products/and or services.
This terms and Conditions shall be governed by and construed in accordance with the laws of the country in which the Restaurant is headquartered and the Restaurant and any dispute arising out of or in connection with these shall be settled by the competent courts from the headquarter of the Restaurant, excluding the possibility of reference to conflict of laws.

Las presentes condiciones se aplican a usted como cliente de pedidos en línea (en lo sucesivo, "usted" o el "usuario" o el "cliente")
LE ROGAMOS QUE LEA ATENTAMENTE ESTAS CONDICIONES. SI NO DESEA QUEDAR VINCULADO POR ESTAS CONDICIONES, NO DEBE ACCEDER Y/O UTILIZAR LA APLICACIÓN DE PEDIDOS EN LÍNEA (EN LO SUCESIVO DENOMINADA "APLICACIÓN DE PEDIDOS EN LÍNEA"). EL ACCESO Y/O USO DEL PEDIDO EN LÍNEA POR SU PARTE SE CONSIDERARÁ COMO SU ACEPTACIÓN DE ESTOS TÉRMINOS Y CONDICIONES.
Sujeto a la normativa legal vigente, podemos, a nuestra discreción, enmendar o modificar de otro modo los Términos y Condiciones de Uso. Le recomendamos que lea detenidamente, cada vez que realice un pedido en línea, las Condiciones de Uso, ya que pueden afectar a sus derechos.
Estos Términos y Condiciones describen los términos y condiciones generales de los pedidos en línea entre Nosotros y Usted y los diferentes derechos y obligaciones de las Partes.
En aras de la claridad, estos Términos y Condiciones se aplican (también) en el caso de pedidos en línea a través de la aplicación (en lo sucesivo, la "aplicación de pedidos en línea" o la "aplicación"; la aplicación es la aplicación de pedidos en línea utilizada por el Cliente para realizar su pedido de diferentes productos y/o servicios (en lo sucesivo, los "productos" y/o "servicios").
La aplicación de pedidos en línea es propiedad y está gestionada por el licenciante del acuerdo de licencia relativo al uso de la aplicación para realizar pedidos en línea.
Sin perjuicio de la generalidad de las presentes Condiciones Generales y en aras de la claridad, Usted debe respetar también el contrato de licencia de uso de la aplicación para realizar pedidos en línea.
El Restaurante hará todo lo posible para garantizar que la información relacionada con el pedido en línea sea precisa y fiable. Sin embargo, esto no puede ser infalible y a veces pueden producirse errores. Usted debe tomar las medidas adecuadas para verificar toda la información relacionada con el pedido en línea antes de utilizarlo. En la medida máxima permitida por la legislación aplicable, el Restaurante rechaza cualquier garantía o representación de cualquier tipo, ya sea expresa o implícita, en cuanto a cualquier asunto relacionado con el pedido en línea, incluyendo, sin limitación, la disponibilidad de la aplicación de pedido en línea.
El Restaurante puede revisar de vez en cuando la información relacionada con la aplicación y/o el proceso de pedido en línea y se reserva el derecho a realizar dichos cambios sin obligación de notificar a ningún cliente anterior, actual o futuro. En ningún caso el Restaurante será responsable de los daños indirectos, especiales, incidentales o consecuentes que se deriven del uso de la información contenida en este documento y/o en relación con el proceso de pedido en línea.
Al realizar un pedido en línea, usted reconoce y acepta que el uso de la aplicación y/o los procesos de pedido en línea se realiza por su cuenta y riesgo y, en la medida máxima permitida por la legislación aplicable, en ningún caso seremos responsables de ningún daño, pérdida, coste o gasto directo, indirecto, incidental, especial, consecuente o punitivo, ni de ningún lucro cesante que resulte del uso de, o de la imposibilidad de utilizar esta aplicación de pedidos en línea y/o cualquier aplicación y/o material de cualquier sitio vinculado a esta aplicación de pedidos en línea (incluidos, entre otros, cualquier virus o cualquier otro error o defecto o fallo en las transmisiones informáticas o en las comunicaciones de red), incluso si hemos sido advertidos de la posibilidad de tales daños. Además, no podemos aceptar ninguna responsabilidad con respecto a cualquier cambio realizado en el contenido de la aplicación de pedidos en línea y/o el proceso por terceros no autorizados. Todas las garantías o representaciones expresas o implícitas quedan excluidas en la medida máxima permitida por la legislación aplicable.
La aplicación y/o el proceso de pedido en línea pueden incluir contenidos, información o enlaces a terceros o a sitios de terceros. El Restaurante no se hace responsable del contenido de dichos sitios ni del contenido de la publicidad o el patrocinio de terceros, ni del cumplimiento de la normativa por parte de éstos. Se puede acceder a los enlaces por cuenta y riesgo del usuario y el Restaurante no ofrece ninguna declaración ni garantía sobre el contenido, la integridad o la exactitud de dichos enlaces o de los sitios con hipervínculos a esta solicitud de pedido en línea. Usted se compromete a eximir al Restaurante de toda responsabilidad derivada del uso que usted haga de la información de terceros o del uso que usted haga de cualquier sitio web de terceros.
Salvo que se mencione expresamente lo contrario, toda la información relacionada con la aplicación de pedidos en línea (incluyendo, sin limitación, las imágenes, los botones y el texto) es propiedad y/o está disponible con el permiso del licenciante del contrato de licencia de uso de la aplicación para realizar pedidos en línea y posee derechos de uso sobre la misma y, no puede ser copiada, distribuida, ni reproducida o transmitida de ninguna forma ni por ningún medio, ya sea electrónico, mecánico, de fotocopia, de grabación o de otro tipo, sin su permiso previo por escrito.
El contenido referido a productos específicos (por ejemplo, alimentos), la disposición y los textos de la aplicación y/o el proceso de pedido en línea, las marcas comerciales y cualquier otro contenido, son propiedad y están protegidos de acuerdo con la normativa legal vigente y no pueden utilizarse de ninguna manera sin el permiso expreso por escrito del Restaurante.
El Cliente no obtiene ninguna licencia o derecho sobre la información en relación con la aplicación y/o el pedido en línea.
Si decide realizar un pedido en línea mediante la aplicación de pedidos en línea, es posible que se le soliciten los datos de contacto completos y/o la creación de una cuenta, y es posible que deba aceptar las cookies. Debe mantener la confidencialidad de sus datos y no debe revelarlos a nadie. El Restaurante se reserva el derecho de suspender el uso de la aplicación y/o el proceso de pedido en línea si usted incumple los Términos y Condiciones.
Usted reconoce y acepta que todos los pedidos se tratan como una intención expresa de adquirir los productos y/o servicios designados por los precios en línea acordados, y nosotros los tratamos como una oferta vinculante de su parte para adquirir dichos productos y servicios. Cualquier variación debe hacerse por escrito, de lo contrario no será vinculante para ninguna de las partes.
La aceptación de cualquier pedido de cualquiera de los productos y/o servicios quedará a la entera discreción del Restaurante. La aceptación de un pedido puede producirse cuando usted reciba un mensaje en pantalla y/o una notificación por correo electrónico y/o un SMS, confirmando su pedido.
El Restaurante se reserva el derecho de rechazar cualquier servicio, cancelar su acceso a la aplicación y/o proceso de pedido en línea, eliminar o editar cualquier contenido o aceptar su/s pedido/s a su entera discreción y sin previo aviso.
La aplicación de pedidos en línea del Restaurante sólo debe ser utilizada por personas mayores de dieciocho (18) años, o la edad mínima legal permitida por la ley, o bien bajo la supervisión de un adulto o tutor.
Todos los productos y/o servicios proporcionados a través de la aplicación de pedidos en línea se hacen "tal cual" y "si están disponibles", y el Restaurante excluye expresamente cualquier garantía, condición, representación u otros términos con respecto a los pedidos en línea o al contenido o los productos que se muestran en ella, ya sean expresos o implícitos, salvo que se indique expresamente lo contrario.
Las imágenes de los productos son sólo de presentación. Los productos solicitados pueden presentar diferencias (por ejemplo, de color, forma, etc.) con respecto a las fotos existentes en el sitio. El Restaurante no se hace responsable en ningún caso de que la descripción de los productos no sea completa.
Los pedidos de entrega también están sujetos a: i)Que su dirección esté dentro de la zona de entrega definida del Restaurante; ii)Que el Restaurante esté en línea para aceptar pedidos en línea; iii) Su pedido puede estar sujeto a un importe mínimo por pedido;
Puede pagar con cualquiera de los métodos que aparecen en nuestra pantalla de pago. Por favor, asegúrese de que si su pedido se realiza con una tarjeta de crédito o débito, la tarjeta sea válida en la fecha de realización del pedido. El Restaurante no puede realizar reembolsos de los pedidos pagados en línea. Póngase en contacto con nosotros directamente para resolver cualquier disputa de pago o reclamación de reembolso.
Es posible que se le dirija automáticamente a un listado en línea que haga referencia a su ubicación de servicio de restaurante más cercana. Tenga en cuenta que los precios, las restricciones de gasto mínimo y las restricciones de gasto máximo en efectivo varían de un lugar a otro. Además, si hace un pedido en línea, el precio cobrado puede ser diferente al precio de los Productos si los hubiera pedido en la tienda o por teléfono.
El pedido en línea, una vez realizado, no puede modificarse ni cancelarse ni a través de la página web ni fuera de ella llamando al restaurante. En cualquier caso, si desea cancelar o reclamar su pedido, llame al servicio de atención al cliente de su restaurante, cuyos datos se incluirán en el correo electrónico de confirmación que se le enviará al realizar el pedido y podremos ver cómo podemos ayudarle.
Intentaremos proporcionarle los productos solicitados lo más cerca posible de la hora de entrega/recogida solicitada, pero no podemos garantizar el plazo de entrega en todos los casos. El tiempo de entrega puede verse afectado por el mal tiempo o las condiciones de tráfico. Esto es para garantizar la seguridad de nuestros jinetes. El servicio de entrega puede no estar disponible temporalmente en determinadas zonas debido al mal tiempo o a circunstancias imprevistas.
El Cliente se compromete a aceptar la entrega de los Productos en el momento y lugar de entrega acordados. Si ha elegido que se le entreguen los Productos, el Restaurante entregará el pedido en la entrada principal de la dirección de entrega, pero las entregas que se realicen en la dirección de entrega sólo se llevarán a cabo si el conductor y usted lo consienten. Si usted no está presente para recibir los productos en la dirección indicada en su pedido, no le reembolsaremos el precio de su pedido y le cobraremos el importe total del mismo.
El riesgo de los Productos se transmitirá al Cliente en el momento de la entrega. Cualquier servicio de software/programa informático se utiliza y/o descarga bajo su propia responsabilidad. Si tiene alguna duda sobre la idoneidad del servicio de software/software que va a utilizar y/o descargar para su ordenador, se recomienda que obtenga el asesoramiento de un especialista antes de utilizarlo y/o descargarlo.
Usted es responsable de mantener la confidencialidad de sus datos personales, contraseña y datos de pago. Usted se compromete a aceptar la plena responsabilidad de todas sus actividades en relación con el pedido en línea (aplicación).
Usted no puede ceder, sublicenciar o transferir de otra manera ninguno de sus derechos bajo estos términos y condiciones. En caso de que cualquier disposición de este acuerdo sea y/o se convierta en nula, ilegal, inválida o inaplicable, no afectará a la validez o a la aplicabilidad de las demás cláusulas contractuales, que seguirán estando en vigor y produciendo efectos legales como si la cláusula nula, ilegal, inválida o inaplicable no formara parte de este acuerdo.
Las presentes Condiciones Generales no afectan a sus derechos legales.
Las marcas del Restaurante, así como las marcas relacionadas de otros y la propiedad relacionada están protegidas contra la copia y la simulación en virtud de las leyes nacionales e internacionales y no deben ser reproducidas o copiadas sin el permiso expreso por escrito del Restaurante.
En la medida en que lo permita la ley, el Restaurante excluye toda responsabilidad que surja de su suministro de los Productos y, en particular, no será responsable de ninguna pérdida o daño que surja directa o indirectamente de o en relación con el retraso más allá de la hora estimada de entrega o recogida; cualquier circunstancia sobre la que el Restaurante no tuviera control de las consecuencias y que el Restaurante no pudiera evitar mediante el ejercicio de una diligencia razonable, o cualquier pérdida indirecta o imprevisible sufrida o incurrida por el Cliente u otros. En cualquier caso, la responsabilidad del Restaurante ante el Cliente no superará el precio total cobrado por los productos y/o servicios correspondientes.
Estas condiciones se regirán e interpretarán de acuerdo con las leyes del país en el que el Restaurante tiene su sede y cualquier disputa que surja de o en relación con las mismas será resuelta por los tribunales competentes de la sede del Restaurante, excluyendo la posibilidad de remitirse a conflictos de leyes.
